Instructions to consumers

  1. The Czech Bar Association (“CBA”) has been authorised by the Ministry of Industry and Trade of the Czech Republic to resolve consumer disputes out of court in the area of disputes between attorneys and consumers.
  2. The CBA is also a supervisory authority over the activities of attorneys in terms of compliance with Act No. 253/2008 Coll., on Certain Measures against the Legalization of Proceeds of Crime and Terrorist Financing (“AMLA”).

Personal data protection

  1. The lawyer processes personal data of clients and their authorised representatives. This processing is necessary for the effective provision of legal services and for the protection of the rights and legitimate interests of clients under contracts for the provision of legal services. The same applies to the processing of sensitive personal data (e.g. health data) only in justified cases and to the minimum extent necessary.
  2. Personal data are processed in accordance with the relevant legislation, in particular the General Data Protection Regulation (“GDPR”).
  3. Selected data are also processed for the purposes of fulfilling the attorney’s legal obligations under the AMLA and other relevant legislation such as tax and accounting laws.
  4. For this purpose, the lawyer is also obliged to collect and store personal data and to make copies of documents. For these purposes, data on name, surname, birth number, date of birth, sex, place of birth, permanent or other residence and nationality; and, where applicable, business name, registered office and personal identification number are processed.
  5. The provision of personal data is voluntary, but a condition for the conclusion and performance of a contract for the provision of legal services. The provision of data for the identification and control of the client is a legal requirement under the AMLA.
  6. Personal data are kept for the period of providing legal services, or for the period specified by the competent or for the time necessary for possible dispute resolution and legal enforcement of the lawyer’s rights.
  7. Personal data may (only to the extent necessary) be transferred to the lawyer’s service providers, public authorities or other entities in the performance of obligations under the AMLA and other legal regulations.

  9. The email address may also be used to request access to, update or rectify specific personal data, or to object.
  10. In connection with the fulfilment of obligations under the GDPR, it is possible to lodge a complaint with the Office for Personal Data Protection (https://www.uoou.cz) or apply to the courts.


Insurance

  1. The lawyer has taken out compulsory professional indemnity insurance for the lawyer’s liability for damage caused in connection with the provision of legal services. The limit of indemnity is agreed at least in the statutory amount.

Cookies

  1. The adamforstadvokat.cz website (“Website”) uses only necessary analytical cookies to measure visitor traffic and behaviour, and only with consent.
    Consent can be withdrawn if necessary.
  2. The cookies collected do not allow the retrospective identification of an individual. They are processed for a maximum period of one and a half years, unless they are only necessary for the operation of the website.
  3. Cookies are processed by Google Analytics in accordance with the terms of service.
